PARTICIPANT RELEASE, ASSUMPTION OF RISK, AND HOLD HARMLESS RELEASE
I, (“Member”) in consideration of being permitted to participate in Crush Crew Jiu Jitsu (“CCJJ”) classes, training and activities (collectively “Training”) and for other good and valuable consideration receipt of which is hereby acknowledged, do HEREBY AGREE, ON BEHALF OF MYSELF, MY SPOUSE, MY CHILDREN, MY PARENTS, MY HEIRS, ASSIGNS, PERSONAL REPRESENTATIVES AND ESTATE TO RELEASE, DISCHARGE, INDEMNIFY AND HOLD HARMLESS CCJJ, THEIR EMPLOYEES, OWNERS, SUCCESSORS, AND INSTRUCTORS, AS FOLLOWS:
1. I acknowledge that engaging in CCJJ Training involves both known and unknown risks that could result in illness, severe physical injury, paralysis, death, or damage or loss of property. These risks include, but are not limited to injuries in the course of Training; risk of injury or illness commonly associated with Training, drilling or other activities (including the risk of negligent acts or omissions). I understand that such risks are inherent to the Training and cannot be eliminated from CCJJ.
2. I further acknowledge the risk that people may commit negligent acts or omissions during the CCJJ Training. I also acknowledge the risk that if I am injured or become ill during CCJJ, any such injury or illness may be made worse by negligent treatment or efforts by third parties.
3. My participation in CCJJ is purely voluntary, and I expressly agree to accept and assume all of the risks of participating in CCJJ. I also agree to accept and assume the risk of possible injuries or illness I may suffer during CCJJ Training, which may be caused by CCJJ instructors, other members or by third parties.
4. I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless CCJJ, their employees, owners, successors, and instructors from any and all claims, demands, or causes of action, which in any way arise from or are related to my participation in CCJJ Training, including all claims alleging negligence if I am injured or become ill in any way during CCJJ classes.
5. I further agree that Pennsylvania substantive law shall govern this release.
6. I agree that if any portion of this release is found to be void or unenforceable, the remaining portions shall remain in full force and effect.
7. This release shall be binding to the fullest extent permitted by law. If any part of this release is deemed to be unenforceable as a binding contract between the parties. This release shall be binding upon my assignees, heirs, next to kin, executors and personal representatives.
I have had a sufficient opportunity to read this entire document. I have read and understood it, and I agree to be legally bound by its terms.
